Terms & Conditions
1. Accepting the Estimate, which includes clearly highlighted and agreed-upon items, signifies that the Client has read and understood the terms and conditions. Any questions should be resolved before the job is defined, and all costs (The Contract) are accepted, and the specified work (as written in the Contract) has started.
2. All Contracts must be confirmed in writing prior to the commencement of work, either through email confirmation or a written acceptance letter. Both should reference the date, client's name, address, and a statement of acceptance of the terms and conditions, thereby establishing a legally binding contract.
3. Liability cannot be accepted for any alterations to the work outlined in the Contract unless both client and contractor have provided written consent.
4. Any additional work performed at the Client's request will incur charges not included in the Contract. Additional labor will be billed, and extra materials will be quoted and approved before the commencement of the additional work.
5. Estimates: Our Company provides estimates as the specifics of work can often change, including the type and quantity of materials, as well as labour costs. As such, the final invoice is conclusive and may vary from the initial estimate.
6. Estimates are only valid for 30 days from the date of issue. Beyond this period, a new estimate will be necessary.
7. For larger projects, Cherry Tree Landscapes requires a 10%-30% deposit upfront to initiate work. All deposits will be negotiated and confirmed with clients before starting work. The remaining balance is due upon completion of the agreed contract.
8. The Client is requested to ensure proper access by clearing any vehicles or obstacles that may obstruct access routes before the team's arrival. Neighbors should be informed where access is needed to perform the work. Additionally, we kindly request that clients with dogs clear away any pet waste.
9. The Client must notify Cherry Tree Landscapes of any services that could obstruct the scheduled work before it begins. This includes water, gas, electricity, drainage, sewage, and any other hazardous obstructions known to the client.
10. Cherry Tree Landscapes will not be held responsible for any damage to services or obstructions mentioned in clause 9 if the client fails to inform them prior to the start of work. It is the client's responsibility to arrange and pay for any necessary repairs.
11. If permissions from another authority are required due to ownership issues, it is the client's responsibility to secure all permissions, issue any notices, and pay any fees as needed. Clients may request Cherry Tree Landscapes to manage this process. All required permissions must be confirmed in writing by the relevant authority and provided to Cherry Tree Landscapes via email or letter.
12. The client is liable for any loss, claims, or legal actions against Cherry Tree Landscapes if they fail to comply with clause 11's requirements before work begins.
13. Cherry Tree Landscapes retains full ownership of all goods and materials on-site until full payment is received. They reserve the right to freely access the site to retrieve these goods and materials.
14. The client assumes the risk for any materials or goods delivered or stored at the work site. Cherry Tree Landscapes is not liable for any damage, loss, or costs incurred.
15. The client will bear all costs and charges for materials made to bespoke designs or specific measurements if site work cannot be performed or continued for any reason.
16. Cherry Tree Landscapes is not responsible for contracted works that cannot be performed or completed due to circumstances beyond their control or for unforeseen reasons.
17. Cherry Tree Landscapes is not liable for any damage to work caused by extreme weather, ground movement, or tree roots.
18. Cherry Tree Landscapes provides a one-year guarantee on its work. Damage occurring after this period will be considered 'wear and tear', and the company will not be liable.
19. Aftercare: The client is responsible for following the aftercare instructions provided by our team. Cherry Tree Landscapes will not be liable for damage if the aftercare is not maintained.
20. Congestion & Parking Charges: The client will be charged for any congestion and parking/permit fees incurred by work vehicles at the job site, in addition to the contract costs, upon job completion.
21. Payment is due upon work completion or within 7 days thereafter. Payments delayed beyond 7 days will accrue a 5% weekly interest charge.
22. Concerns or complaints must be reported to Cherry Tree Landscapes within 7 days of work completion.
